Terms and Conditions for E-Commerce Sales

We provide you the opportunity to purchase and receive products through our Website under the following terms and conditions (“Terms of Sale”):


1. Orders

a. For each product listed in your Checkout Summary, placing an order constitutes an offer from you to purchase that product from Fansonline. A contract for supply is formed when your payment is processed, and we send you an email confirming your order.

b. When purchasing products from us, you agree to these Terms of Sale for all products included in your purchase.

c. We are responsible for dispatching the products to you, as outlined in these Terms of Sale. Please refer to our Shipping Policy for more details.

d. All accepted orders override any previous quotes or estimates provided.

e. We reserve the right to limit the quantity of products available for purchase by you.


2. Information about Products

a. Due to variations in photographic and screen displays, the appearance of some products may differ slightly (e.g., in colour) from how they appear on the Website.

b. Each product includes specific installation and maintenance guidelines (“Product Instructions”).

c. Please review the Product Instructions thoroughly before installation and adhere to maintenance guidelines to maximize the product’s value.

d. If a product requires installation by a qualified professional (“Qualified Expert”), ensure that a Qualified Expert performs the installation. Failure to do so will:
i. Void any associated warranty.
ii. Void any right to return the product under our Returns Policy.


3. Pricing and Payment

a. All purchases must be paid in full at the time of checkout using one of the payment options available on our Website. Orders paid via direct bank transfer will not be fulfilled until the payment clears. If we cannot fulfil an order, a refund will be provided as outlined in Clause 8.

b. All prices, including delivery and other charges, are displayed in Australian dollars and include GST.


4. Delivery

a. Delivery options and associated costs are outlined on our Website and will be reflected in your Checkout Summary. We aim to deliver within the specified timeframe.

b. You will be notified via email once your products have been dispatched.

c. If delivery delays occur, please contact us for:
i. Updated delivery estimates.
ii. Assistance in finding an alternative product.
iii. Cancellation and refund options for undelivered items.

d. We are not liable for delivery delays beyond our reasonable control.

e. You must ensure safe and clear access for delivery.

f. During checkout, you must authorize us to leave products at the delivery address if no one is available to accept them. Ensure the area is safe for delivery contractors to leave the product. Additional delivery fees may apply if delivery is deemed unsafe or unsuccessful. If you do not wish to have the item(s) redelivered at your cost and are not able to collect the goods, the item(s) will be returned to our warehouse at your cost and we will refund you the difference less any restocking fees and freight charges initially absorbed under our free shipping promotion.

g. Some products may require extra equipment or personnel for delivery, which will incur additional charges disclosed prior to order submission.

h. Clauses 4(d)-(g) apply to deliveries within Australia. Orders requiring international shipping will follow a different process.

i. Upon delivery:
i. Refer to our Returns Policy for details on your obligations when receiving products.
ii. Inspect the products and report any issues (e.g., defects, discrepancies) as soon as possible. Avoid opening boxes until confirming you have received the correct items.


5. Title and Risk

Ownership and risk of loss or damage transfer to you upon product delivery.


6. Warranties and Liability

a. Products come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for major failures and compensation for foreseeable loss or damage.

b. Manufacturer warranties may be included with the product. Review warranty terms provided by the manufacturer or visit their website for details.

d. Certain products may be sold “as is,” and returns will not be accepted for these items. You will be informed of “as is” terms before purchase.

e. Except as required by law, all other warranties are excluded. For non-domestic purchases, Universal Fans’ liability is limited to a refund, replacement, or repair of the product at our discretion.


7. Order Cancellation

a. We reserve the right to cancel an order (in full or part) if:
i. We suspect the purchase is for resale, except for authorized builders or tradespersons.
ii. The product is out of stock after order confirmation.
iii. A pricing or product description error occurs.
iv. Abusive or threatening behaviour is exhibited toward our staff.
v. Fraudulent or criminal activity is suspected.

b. Refunds will be issued for cancelled orders. For partial cancellations, a refund will cover the cancelled portion.


8. Refunds and Returns

a. Our Returns Policy is available here.

b. For discretionary product returns (non-warranty and non-faulty items), we reserve the right to accept or decline the return. Approved returns may result in store credit, valid for 12 months from issuance.


9. Privacy

10. Dispute Resolution

11. Inconsistency
